OTN: POLLUTION PANEL ONLY GLARES .NO WILL POWER TO TAKE ACTION

Dear All,

OSPCB has only identified the Polluting Industries in the State. What prevents them to take action against polluting industries, based on their findings ? If they have NO authority to take action, then what is the purpose of having a big Organization, at the expense of Tax payers’ money?

Engaging IIT or School of Mines or NERI for detailed studies is nothing but buying time and to forget in due course of time.

OTN: ANOTHER CTL PLANT NEAR TALCHER

Earlier we had seen News reports that the TATAs and ESSAR are going to set up CTL Plants in Orissa. Now Jindal Steel & Power is planning to set up yet another CTL Plant.

My concern is what will be the impact on the Ecology & Environment of Angul – Talcher belt by these Mega Coal based Projects. Angul-Talcher belt has already attained the distinction of being one of the top ten polluted zones of the Country.

If we have so many Home Grown Mega Investors, do we really need outsiders like POSCO to exploit our resources, land, water and Air, almost at free of cost, dump the mountains of wastes on our Soil , discharge millions of gallons of effluent into our Rivers and then carry the semi finished Steel to Korea for true value addition and make windfall profit. ??

JSPL may ink MoU for Rs 42K-cr CTL plant next month

Targeting an investment of Rs 1 lakh crore in Orissa over the next one decade, the Naveen Jindal-led Jindal Steel and Power (JSPL) today said the company is likely to sign an MoU with the state for setting up a Rs 42,000-crore coal-to-liquid (CTL) plant next month.

OTN: Story of Karnataka Iron Ore scam in it’s investigating Lok Pal’s words in Rediff interview – Sandip

Being a comparatively advanced society – the Lokpal is not kow towing the CM & the ministers, involved. In Odisha the unity among checking agencies with the executives is disheartening. In Odisha also train loads of Iron ore, what to talk of Truck loads of them have disappeared, amounting to millions of Tons. The similarities are eerie and evident to common eye. Please read and see if ideas come to you?

What is more ominous, GoO(Govt of Odisha) knowing fully well that such is the state of it’s state, is continuing to grant licences to private sea ports, one after another. Some of them like POSCO’s will be under EPZ (Export Processing Zone) laws. Yet POSCO is allowed under MOU to export 400 MT of Iron Ore and re-import equal quantity.

Who will keep the book?

With laws, agencies, officers in place and an active state police – so much stealing is happening. How come Govt thinks that such authority can be given away to POSCO EPZ officers, with no records, needed(Income Tax, Sales Tax, commercial Tax not being due) and POSCO remaining honest. Common sense tells you that it is like handing over security authority to the thieves. Best wishes, Sandip

On Monday, Opposition Congress and Janata Dal-Secular MLAs and MLCs spent the entire night in the Karnataka assembly, seeking to mount pressure on the B S Yeddyurappa [ Images ] government to order a Central Bureau of Investigation inquiry into it.

In this first-person account to *Rediff.com*’s Vicky Nanjappa, Justice Hegde speaks about the scam, his resignation and its withdrawal.

Chief Minister B S Yeddyurappa has recently admitted that 35 lakh (*3.5 million*) metric tonnes of iron ore have gone unaccounted for. Let us not just sit back and think that is the entire extent of the scam.

Although I welcome that the admission, I still would say this is only part of the seized material and the statistics are for the period between October 2009 and March 2010.

I would like to point to the rest of the figures. The CM’s statement is in respect of the Bilikere port alone. When we take into account the rest of the ports where ore is being transported in the past four to five years, the figure may easily be around 100 lakh (*1 billion*) metric tonnes which is easily worth over Rs 2,500 crore, which makes it the biggest scam India has ever seen.

The ore is being illegally transported to other ports like Karwar, Mangalore, Goa [ Images ], Kakinada and Chennai on the east coast. Iron ore is being illegally exported to these ports too.

However the problem is when it comes to Goa and Chennai, we lose jurisdiction. We have sought details from the state mines and minerals department and have been getting shocking statistics. The state has lost a lot of revenue.

Now the general argument would be as to why I am valuing the ore so high when the state gets just Rs 27 per tonne. It would not be fair to valuate it this way. What if the state had extracted the ore and decided to sell it. They would have got the same value as the illegal miners.

What can one do if the state has a policy of pampering private miners and in the bargain is throwing away its property?

It is not hard to crack this scam. My officers are on the job and the entire picture will come out. However, if they give us better infrastructure then we would be able to do it better. My officers are already on the job as we speak.

There have been allegations that some persons in power have been trying to interfere with the investigation. They have done nothing to me or with me directly so far.

I would refrain from taking any name unless there is concrete evidence. The fact of the matter is that nothing in Karnataka is done in their name.

In my report I have clearly mentioned that there are large instances of empty trucks coming in from Andhra Pradesh. They come in with permits from Andhra Pradesh and then enter Karnataka and fill up the trucks. Now you may say there are various checkposts but they can be purchased like peanuts.

When we speak about the AP connection, it only indicates who the people are. No one else can do things like this. It is not easy to pick up fake mining licences and permits and fill up trucks.

When we conducted a seizure recently we realised that most of the permits originated from AP, mainly Kadapa. How do these people manage to get permits from Andhra Pradesh and how many people from Karnataka are capable of getting a permit from AP?

I won’t name these people unless I have material on hand. Such an investigation may take time, but then there is also an issue on whether I would be permitted to conduct an investigation on these lines.

I had resigned since I was upset that certain powers were not handed over to me. I then withdrew the same based on assurances from the government. The government has given me powers but have excluded *suo motu* powers to proceed against the chief minister and his cabinet colleagues.

You asked me if this power could be used arbitrarily by another Lokayukta. But believe me, in their heart, they may just hand over this power to another Lokayukta, but they will never give it to Justice Hegde.

Another point of debate is this may shake up the balance of the government if the Lokayukta proceeds against the chief minister and he may have to step down.

Isn’t a common man always under the scrutiny of the law? The common man, if booked, can go up to the court and prove his innocence. The CM can do the same. Doesn’t a CM have the right and power to go up to a court and prove himself?

Now the question of a CM resigning in case he is proceeded against. I will not buy this argument at all. Did Lalu Yadav [Images ] resign, did the CM of Jharkhand resign? (*when cases were registered against them*). Even if a CM is proceeded against, he can always tell the people that he will fight it in court and if the charges are proved only then will he step down.

I find it very funny. A sub inspector can book a case against the CM, but a Lokayukta cannot.

I am also pretty perturbed by some of the statements from the corridors of power. Recently a politician said that me asking for power is politically motivated. I only want to ask them as to why do they always judge us by their own standards.

However, I am not deterred by this refusal to grant *suo motu* powers. I had told you earlier too that under the Prevention of Corruption Act, I still have the power to proceed against the CM or any of his ministers based on a complaint against them

OTN: SKEWED FEMALE SEX RATIO IN ODISHA

Dear All,

Some time back entire Nation was concerned over the rapid decline in the Female sex Ratio in affluent States of Punjab,Haryana,Gujarat and Delhi.

Surprisingly, our Own State specially the relatively better off districts of Odisha have started showing very low Female Sex ratio. Here is the report from the Telegraph, dated the 12th July with the full story.

From the story, it may be noted that poorer and less literate Districts have scored better than their counterparts in so called more literate Districts with better per capita income.

This is certainly an alarming situation. Unfortunately the general Society has not changed the age old mind set that a Female Child is a liability. To make matter worse, suicides of brides, even in highly educated Section of the Society, because of alleged exploitation/harassment by the In-laws , continues unabated.

OTN: To be where you are not – A link to the OSA General body meeting…on 4th July

Dear Friends: In 1988, I attended, WFS (World Future Society) meeting at Washington DC of which I am a member. One of the Keynote speakers, he was then Bell Lab’s chief in his key address said & I quote: “one of man’s wishes have always been “To be where you are not”, man has achieved it today through telephone/ and video”. Little did he know in another 21 years hence you can actually be where you are not, literally. In fact with technology probably by next year, you can take part in the General Body of OSA, without being there. For last 3 years ( starting 2007 Execs term), OSA, BoG meets roughly every month, over phone for free. – From 2011 GBM, it may be possible to remotely participate. OTN: Cry to Save Mahanadi getting Louder!

Please find a News Report on “Opposition to Government’s latest Policy to divert Mahanadi Water for Industries”.

The People’s concern is genuine as Water availability for Cuttack City and its suburbs and also for Summer crops in Mahanadi Delta during the dry Summer months, will be seriously affected if water is diverted for Industries.

Before taking any decision on this sensitive Issue, Government must provide detail information, for the last 5 years, on Water availability during the Summer months, at different take off points including the dead ends of Canal Network system.

Incidentally the Taladanda Canal in Cuttack City (built by the British in the 19th Century) turns into a stinking Cesspool during the dry Summer, obviously owing to lack of adequate fresh water discharge from the Jobra Barrage. This symptom proves that the Jobra barrage does not have adequate Water even for feeding into the existing Canal System, during the Summer season.
